Assessing The Legal Authority of Circumstantial Evidence in Islamic Jurisprudence: A Critical Review

This research article examines the evidentiary status and legal significance of circumstantial evidence (Qarā’in) in the Islamic judicial system, particularly in relation to the establishment of claims (Ithbāt al-Da‘wā). The study highlights the perspectives of classical and contemporary jurists regarding the admissibility and authority of traditional and modern forms of circumstantial evidence. It also discusses the role of forensic, documentary, and digital evidence within the framework of Islamic law. Furthermore, the article analyzes the effectiveness and persuasive value of Qarā’in through relevant examples, concluding that reliable circumstantial evidence plays a vital role in achieving justice and strengthening judicial decisions in accordance with the objectives of Sharī‘ah.
