An Analytical Study of Collective Ijtihad and Organized Ifta to Overcome Juristic Stagnation

This study contends that contemporary challenges confronting the Muslim Ummah can be effectively addressed through collective ijtihad and a systematized framework of iftaʾ, rather than through isolated individual fatwas. It identifies juristic stagnation as a consequence of unregulated fatwa practices, dependence on unqualified muftis, and legal rulings disconnected from social realities. The study explains that effective iftaʾ is grounded in three essential components: the mustaftī, the muftī, and the fatwā, each bearing defined ethical and scholarly responsibilities. Emphasis is placed on methodological rigor, contextual awareness, moderation, and adherence to the objectives of Islamic law. The research concludes that institutionalized and collective mechanisms of iftāʾ are vital for producing balanced, applicable rulings and for overcoming juristic stagnation.
